Service Plan Fair Use Policy

FAIR USE POLICY

In order to assure that all clients have same access to the service advantages, SATCONXION has implemented the FUP in all the services, this control system called SmartBand CAB.
SmartBand CAB is a tool designed for optimizing a shared bandwidth and with different use types per user. The tool administers the total bandwidth use and optimizes the bandwidth available per user, allowing it to sort by service classes and user groups.

A data access service is normally described and provided in terms of its max bandwidth. This is the first factor that defines a service class. The variable that SmartBand CAB mostly uses for optimizing is the average speed of a user.

The SmartBand CAB tool allows the monitoring, identification, automatic control and/or manual bandwidth control, each one applied in detail or as an added.

This control can be applied to individual users, pre-defined user groups, on-the-go defined user groups or all the users.

SmartBand CAB automatically and dynamically supervises:


Network state


The global net state (the global bandwidth). Our goal is to give the maximum bandwidth assigned to each user until the global use gets close to the limit we have.

A global use roof limit is defined (e.g. 800kbps of a 1Mb bandwidth) so that in that moment the CAB starts to work. The CAB keeps working until the use goes down below a global use floor limit (e.g. 600kbps of a 1Mb bandwidth), where the CAB deactivates allowing that each connected user in that moment can have all his bandwidth available again.

The 80/20-Fair Use Policy (FUP) rule

As a default rule in a shared bandwidth case, SmartBand CAB starts with an 80/20 rule. That means that the goal is that 80% of the connected users can have the best possible QoS (Quality of Service) under the available bandwidth.

This rule is a quantification of a fair shared use policy, the Fair Use Policy (FUP). The FUP is the expression of the attempt of the administrator of giving a satisfactory service to the biggest number of users.


Penalization

The first implication is that all users that consume a lot more than the average are using "more" than what is fair for all the other users. We call this type of intense user a "heavy user". When it is activated, SmartBand CAB executes the FUP with these users, reducing the average bandwidth so that the majority of users do not see their bandwidth affected by the disproportioned use of some few.


SATCONXION reserves the right of:

(1) Limiting the clock and indexes of processing performance of certain intensive bandwidth activities including, but not limited to, audio and video streaming, and automatic file exchange applications; and/or
(2) discontinuing the service supply by specific ports o communication protocols.
SmartBand CAB allows penalizing of heavy users with penalization degree control parameters.


Bonus

The second implication is to contemplate the opposite of penalizing the heavy users: give a bonus to the best users. That means that the users that use less the bandwidth will be, as a goal, the ones that will enjoy more of their maximum capacity. When the CAB is activated, the administrator can give a bonus to a group of users so that the CAB penalizes them less.

SmartBand CAB allows "giving a bonus" to the users with the penalization degree control parameters but easing the CAB, instead of intensifying it like in the case of the heavy users.


User profile-Consumption history

To help identifying the heavy users and the VIP users, SmartBand CAB keeps a history of their consumption. This lets us defining groups of users based on their consumption profile. The user groups help us manage the QoS received by each user, on the one hand, allowing an automatic control based on their historical profile, and on the other, sharpening the degree control resolution.

It is possible to define any kind of groups. By default, Smart Band CAB is initiated with five groups, splitting the users by historical consumption in 20% increments.

The initial goal is to designate group users in order to give them different QoS levels, by penalization or bonification.

The group definition is configurable by the administrator, following any business rule defined.

The service categories are defined by their max speed and the average speed goal of each service.

A penalization or bonus degree is applied to each defined group. SmartBand Cab starts at default with these parameters:

FUP attached rules:

1. The communications use of SATCONXION is controlled, in the High Speed Internet service that it gives. This policy is subjected to the definite agreement made between SATCONXION and the service user ("client") that controls the service supply to their users. The service use by the client or third party constitutes the consent of them to the terms and conditions of this policy. The clients will rigorously follow the terms of this policy, and will use reasonable commercial methods to make their subscribers and users follow all the provisions of this policy. All the subscribers and users will follow rigorously the terms of this policy. SATCONXION, acting in a reasonable way, reserves the right to modify or clarify, notifying in writing to the client 30 days before such modification or clarification, and that modification or clarification will be effective when its put, once revised, on the Web site of SATCONXION in www.satconxion.es (or in the successor Web site that could be signalled in time to time by SATCONXION).


2. Rules of use. A user of the service can not:

i. send, transmit or distribute material that constitutes, or causes any behaviour that may constitute a criminal offence or cause civil responsibility, or use the service in a way prohibited by the law or that may restrict or inhibit any service user of using or enjoying the Internet Service;

ii. send, transmit or distribute material that it is known to be or may be fake, illegal, harasser, defamer, profane, invader of the privacy of others, abusive, threatening, harmful, vulgar, obscene, of explicit sexual content or offensive in any way;

iii. send, transmit or distribute material that constitutes "Spam" including, but not limited to, non requested e-mail messages, inadequate postings in news groups, fake commercial messages, mail bombardment (that being massive e-mail sending to a system used to damage that system) or any other abuse of the e-mail servers or news groups (and except of the defined by law, the "non requested e-mail messages" do not include any message: (i) directed to a individual with whom the sender may have a pre-existing business or a personal relation; or (ii) received of an organization or non-commercial entity of which the user may be a pre-existing member;

iv. send, transmit or distribute private information about government companies, enterprises or entities;

v. send, transmit or distribute any software that contains virus, "bugs", evil code, "cancelbot", "Trojan Horse", "worm", or any other evil component or transgressor;

vi. upload or download, send, publish, retrieve, transmit, or in any way reproduce, distribute or provide access to information, software or other material that: (i) could be confidential, or protected by copyright or any other intellectual property law, without the previous authorization of the rights holder; (ii) could be defamatory, obscene, constitute an invasion of the privacy or appropriation of a third party's personality;

vii. sending of non requested e-mail including, but not limited to, "junk mail", e-mail strings, advertising mail and advertising information;

viii. violate, or attempt to violate, the security of any computer network;

ix. enter, or try to enter, to an account without the right of doing it;

x. use any other mail server to retransmit E-mail via Internet;

xi. incorrectly restrict, inhibit, interrupt, or degrade the service use to third parties or incorrectly restrict, inhibit, interrupt or degrade the capacity of SATCONXION of distributing the service;

xii. realise, or attempt to realise a bad-intentioned act that may reasonably cause damage or deterioration to the high speed Internet network or to the hardware, software, privacy, service use, or third parties Internet use;

xiii. install automated search and download programs or automated or manual similar routines that could generate excessive Internet traffic quantities;

xiv. provide Internet access to third parties with a manual dialling connection, multiuse interactive forums, or similar means;

xv. provide Web hosting, FTP or Peer to Peer services, included, but not limited to, Aimster, Morpheus, Limewear, Bearshare, AudioGalaxy, KaZaA, WINMX-Napster, Gnutella, eDonkey, eMule, etc…;

xvi. get involved in any activity that could violate the generally accepted standards about conduct and Internet use, included but not limited to, negation of attacks to the service, Web page disfiguration, exploration of the port and network and unauthorised system penetrations;

xvii. disqualify or reject to implement the system adjustments without the express consent and in writing of SATCONXION.

3. Is responsibility of the subscriber to be sure of that the computer equipment used for having access and for using the service fulfils the minimum requirements for using the service as indicated by SATCONXION. From time to time, the computer equipment required for having access and using the service can change. Consequently, the computer equipment of the subscriber can stop being adequate for having access and using the service.

4. Risk control and responsibility. SATCONXION does not assume any responsibility of the acts or omission of a subscriber or of any service user. The account and password protection, if it exists, will be responsibility of the subscriber.

5. Monitoring. SATCONXION does not have any obligation of monitoring the service. However, in order to protect itself and their subscribers, SATCONXION will be able to monitor electronically the service from time to time and divulgate and information regarding the users, necessary to satisfy any petition of the law, regulation or legal requirement. SATCONXION will no monitor or divulgate intentionally any private e-mail message, unless it is required by the law. SATCONXION reserves the right of rejecting the sending or of retiring any information or materials, in their totality or in part, that could be determined to be unacceptable, undesirable or that violate this policy.

6. Content. The client and each of the service users recognise that certain contents, products or services available with or without the Service can be offensive or can not fulfil with the applicable laws. Nor SATCONXION nor any of their affiliates has the obligation of monitoring any content. Nor SATCONXION nor any of their affiliates has the obligation of monitoring the Service use by the client or user and, except of what is here commented, does no have control over that use. The service user assumes that responsibility and the total risk of the access or use of the Content or of the service use. SATCONXION and their affiliates do not assume any responsibility of any demand or loss coming or in any way regarding the access or use of the content by third parties.

7. Privacy. SATCONXION can not guarantee the total privacy, since the delivery control of the requested information by the IP access is not controlled by SATCONXION, SATCONXION only ports, by means of the IP network, the information that is previously requested by the user.

8. E-mail. Sending non requested e-mail messages, including, but not limited to, commercial publicity and informative publicity is prohibited. The users will not use the mail server of other site, without authorisation of the proprietary of this Server, to retransmit the mail.

9. System and network security. It is prohibited to the users to violate any system or network security measure, including, but not limited to, the unauthorised access or the network use, of data or of SATCONXION or third parties information. The users are not authorised to monitor the data, systems or network traffic of the SATCONXION network or of third parties. It is prohibited to the users to interfere with the service supply to any user, host or network by any means, including, but not limited to, "mailbombing", "flooding" and deliberate attempts of overloading a system.

10. If the Client, a Subscriber or any service user does not follow this policy, then, besides any right and resource available for it, SATCONXION can, after using commercial efforts to resolve the policy violation with the Client, and allowing the enough notice time as it can reasonably be in such circumstances:

i. Limit or discontinue the service supply to the Remote Terminal of a user that could have violated the precedent obligations; or

ii. Block the sendings, transmissions, or content distributions that violate this policy, before such contents are remitted or are sent in another way to their receivers.

11. In order to secure the equal access to the Service to all the users, and to protect the integrity of the service, SATCONXION will have right to take measures to prevent the incorrect or excessive bandwidth use of the Service by the Service users such as it is expressed in the use of the SmartBand CAB.

The user declares having read and gives its full conformity.
